SREA Files Surrebuttal Testimony & Exhibits in Ark PSC Docket 25-047-U

The Southern Renewable Energy Association today filed the Surrebuttal Testimony of Simon Mahan on behalf of SREA in Arkansas Public Service Commission Docket 25-047-U. The testimony can be downloaded here.

SREA made the following recommendations in this docket: 

  • Recommendation 1: The PSC should deny EAL's application in this docket. EAL has not shown that grant a CECPN or CCN for JPS is in the public interest under the applicable statutory standards for major utility facilities, nor has EAL shown that JPS is a strategic investment under Act 373.
  • Recommendation 2: Next, to enforce compliance with RPG 4.6, EAL should be directed to issue an expedited all-source RFP process that enables all generation resources to bid in a fair and consistent manner.
  • Recommendation 3: Then, after the bids are received, EAL should perform robust sensitivity assessments fairly comparing all the reasonable generation options and alternatives to JPS.
  • Recommendation 4: EAL should submit a CECPN or other application to the PSC for review and approval. If more time is needed for facility construction, EAL can rely on the MISO capacity auction in the short term or some other short-term bilateral capacity agreement, something the Company already plans on doing.
  • Recommendation 5: The Commission should enforce Order No. 1 and require EAL to hold to an absolute minimum the amount of data to be protected from public disclosure. Specifically, the Commission should require EAL to file unredacted copies of any testimony and exhibits that were improperly redacted, and to provide confidential information to SREA's reviewing representatives pursuant to the terms of Order No. 1 and the filed NDAs to the extent that such information is confidential but not highly sensitive.
